the oath that i take when i serve when i am sworn in in january. >> chambliss already made a similar statement last week. the question is is this a real softening of positions? does it give them room to make deal. >> two things. first, let's look at the real room being created. so far i haven't heard anyone say i am willing to raise marginal tax rates as part of a deal. they're arguing with the head of the antitax coalition about whether closing loopholes is breaking the pledge. it is pretty narrow. it does show they're frustrated because they were sent to washington to negotiate, make deals, make things happen and they find themselves ham strung by this guy that voters haven't really heard of and saying who elected him? >> a lot just know they don't want to go off the fiscal cliff. here is the question.

if republicans are building to eliminate deductions for wealthy, make the wealthy pay more, is it too far for democrats to push to get rates increased? what's the difference? >> i think the real problem here with democrats as far as democrats are concerned is how willing to do sbiegts entitlement reform are they? you heard lindsey graham say he is willing to change position on taxes if democrats come to the table with entitlement reform. president obama privately indicated he is willing to stick his neck out and durbin willing to do that and will nor liberal democrats come to the table with entitlement reform. we'll see if that is a bigger dynamic that changes this week. >> what is the danger i guess is one question because there are democrats like patty murray saying it isn't a cliff, it is a slope. >> the danger is a massive sudden drop in government spending and even if you hate government spending, spending

does keep the economy going and when you cut that much spending all at once abruptly you create a shock to the economy and that is dangerous and there are economists that say it could send us into recession again. >> it is not going to happen immediately on january 1st is their point. >> the alternative perspective is if you believe in preserving entitlements, social security, an eventual deal, a real deal, how much different would it really look from what is on the table with the fiscal cliff? >> that's a good question. let me read to you what congressman peter difazoo told politico. if the republicans can't see their way to significant additional revenues target to the people who are best off and passive income and other things like that, then we're better off going over the cliff and readdressing this with a better congress in january so then i guess the question becomes will things be much different with this different congress if the leaders are the same.

>> we are going to have new house members. look, we have seen senate republicans say that they are willing to negotiate and change some things on taxes. the thing i am wondering, though, chris, is with all of these senate republicans who are very conservative coming out and saying that they're willing to raise revenue, are they providing some cover for more house republicans to come to the table this week? that's the real question. we're looking at house republicans and will they be willing to do a deal? maybe it is that there are some more moderate republicans, doubtful, who come into congress in january who will be willing to negotiate and we have yet to see, but, look, it doesn't really matter. we are seeing republicans start to come to the table and are willing to negotiate. >> i want to bring in congressman john yarmouth from kentucky and on the budget committee. good morning. >> hi, chris. >> democrats seem like they're digging in.

are you worried about democrats over playing their hand? >> i think from democrats that have had one consistent position and that is however we try to deal with the deficit it has to be balanced and it has to call on wealth the wemt iest americans to do their share, and that's all we're looking for, so i think people are dreaming if they think we're going to get a deal on entitlements in three weeks. that is not going to happen and i think it would be irresponsible to try to come up with any approach to entitlement reform in such a compressed period of time. >> reasonably what do you think can get done in the next three to five weeks until the first of the year? >> i think we can head off the problem with everybody's taxes going up. the senate has already passed a bill extending the tax cuts for 98% of the american people. that's a real easy one if speaker boehner can deliver maybe 30, 35 votes. i think we would be happy to pass that and avert that huge tax increase at the end of the

year or beginning of next year and we can extend the spending limits and delay the across the board cuts until a more comprehensive balanced approach is negotiated. >> senator bob corker is putting out a plan that includes a trillion dollars in revenue. he says he would cap deductions and this morning he did not rule out raising the capital gains rate. take a listen. zp there is a menu of options on the revenue side and the entitlement side and as long as there are two parties that are willing to solve this problem, this is a very easy thing to do technically. what it takes is political courage. >> i guess there are two questions there. is it easy technically and is right now what's missing the political courage to make some tough decisions? >> well, you know, i think senator corker is right. technically it is pretty easy although it is not as simple as some people make it. i mean, capital gains if you're talking about changing the capital gains structure you're talking about changing rates,

and i don't know how republicans will deal with that if you raise the capital gains tax rate to 28 or 25% from 15%. you can do it we eliminating deduction but that's word games and semantics and i think the republicans have to get over this concept there are some different between raising revenue and raising taxes and it doesn't really matter to individuals. they either will have more money in their pocket or they're not. this is a game to nullify grover norquist. some members put forth an option to tax the first $400,000 of income and people making more than that at 35%. all that does is increase everybody's taxes over 400,000 by 30,000. somebody at 450,000 gets hurt badly and somebody at 20 million isn't touched at all. >> honestly, those are the

number that is make some people's head spin and makes -- >> i understand, absolutely. >> and the average constituent say i don't know what's going on here. what is your message to folks? what should they be looking at and how do they figure out where they stand on this? as you may well know, the obama administration is trying to get all of those people who voted for the president to come on board and say this is what we want and to press congress to make a deal but it is sort of hard to figure out what is fair. >> exactly. i said to my staff last week we need a big charge that shows the options and how much money is delivered or caused by each step we might take. i think for the most americans they have to know that no matter what we do, taxes are not going to go up on 98%, those people making less than $250,000 a year. where we go above that, i think our side is very, very necessity gloeshable. if there is a number that makes more sense, a half a million dollars to raise the marginal rate, a million dollars, we can

look at that and we would be willing to do that and so far the republicans have not been willing to budget one inch on rates and again this is all a matter of semantics. it is not dollars so they ought to be willing to put everything on the table on the revenue side. >> what they might say is and let me get your answer. you said we're not going to get entitlements done in three weeks and in fact you think it would be irresponsible to do that. without entitlements on the table, without entitlement reform, are you going to get the kinds of concessions from the republicans that you need to do a deal? >> well, maybe not, and that's why i think peter's comment is probably very apt. we probably are better off in that respect if they're not willing to compromise just on the tax side before the end of the year we're probably better off waiting until next year with a different congress and more time to actually deal with the more comprehensive approach, but again all we want to make sure is it is balanced and that the americans who have done extremely well over the last ten years or so contribute to this

deficit reduction program that we have. >> congressman john yarmouth. good to see you. thanks very much. >> we already talked about norquist whose influence seems to be diminished and there is a couple of other big players and i think we need to talk about paul ryan. the big headline is on cliff ryan faces two paths, will he stick to ideological purity or compromise to get a deal. how influential is he? >> we haven't heard much from paul ryan. i was more intrigued with eric cantor, so often the thorn in the side for speaker boehner is now saying he wants to get in there and do a deal. >> it was definitely a more conciliatory tone. he didn't give too many specifics but it was a different tone. >> in some accounts it was cantor's pressure in leaving conservative house members against boehner a bit and that first time around that helps settle things a little bit. i thought cantor was saying

publicly was the big tale and paul ryan i haven't heard much from yet. >> and the other people trying to get in are the governors especially the delaware governor jack markell on a conference call with joe biden and a dozen mayors went to washington, d.c. to lobby lawmakers. are states more scared of going off the fiscal cliff? >> sure. state budgets would be impacted dramatically and very bad for them. governors are very concerned about cuts to education funding. we'll be hearing a lot more from the governors i am sure in the next week or so. >> how influential can they be on capitol hill some. >> extremely. everybody understands state government mostly delivers services, spends the money. a lot of the federal government, a lot of the federal budget is entitlement programs that are basically hazardous, so when you cut state spending you have a real effect on the economy and when you take away federal

teenager was killed and 40 others hurt when the demonstrations turned violent sunday. the protests began after morsi expanded power including preventing courts from revoking his decisions. joining me new is michael sink. protesters calling him a dictator, no better than ho mubarak. >> this is the ate latest in a series of moves he engaged in. in august he sidelined egypt's military council and took their powers for himself, the legislative and constitutional assembly powers they had and the only check remaining on his power after that time was the judiciary and now he swept aside that check. he has consolidated all power for thims and asked the people to trust him and guide egypt through this transitional

period. >> protesters want him to step down. what do you see happening here? >> looks like neither side is prepared to back down. you're right. they're not prepared to trust him. morsi is not some sort of reveered national figure that played a role in the revolution. he seems a very partisan guy that really has islamist interests at heart so the liberals see no other choice but to go out in the street and protest until morsi backs down and looks like now both sides are angling for a compromise. >> what can the west do? >> i think it is no mistake this is taking place after the gaza conflict. the movie mentioned last year took place after a big terrorist attack in the sinai so i think he is hoping he will get a free past because he played this role on the world stage and i think

we need to take that's not the case and we hold him to account for what he does domestically and regionally. >> in cairo today delegations from israel and hamas are there for indirect talks to work on details beyond the initial cease-fire. i have a list of topics they're expected to cover, opening border crossings, easing israel's economic blockade and what do you expect from these discussions today? what are the chances any progress will be made? >> i think these already tough discussions. all the leverage that comes with having the military action on going is gone now. the pressure to make tough concessions and compromises is diminished and morsi is very distracted biz his own domestic crisis. i think you can have these talks go on for some time without major changes and that sets up the prospect for more conflict in the future. >> during this time if it takes awhile will the cease-fire hold?

>> i think right now neither side has interest and i think more israel if iran starts to rearm hamas very quickly and i think they will see that as an untenable situation and it is possible you could over the next weeks see a resumption in some level of fighting. >> michael sing, good to see you. thank you so much. >> he once said he would block her if she is nominated as secretary of state. john mccain sounds like he is softening his opposition to u.n. ambassador susan rice. >> is there anything that ambassador rice can do to change your mind? >> sure. she can give everyone the benefit of explaining their position and the actions that they took and i will be glad to have the opportunity to discuss these issues with her. >> this past wednesday ambassador rice said she relied only on the information she was given by intelligence officials when she said the attack on the benghazi consulate was sparked by an anti-muslim film protest.

back to normal quickly. the state department says the fire appears accidental. president obama bought a few books on small business saturday. he took his daughters to the one more page book store in arlington, virginia, and the commander in chief purchased 15 books, gifts for family members for christmas. we are waiting for our first glimpse of the capitol christmas tree expected to arrive later this morning. it is 65 feet tall and cut down from white river national forest in colorado. decorators will place 5,000 ornaments on the branches. if you read just one thing this morning, in honor of what was a blockbuster movie weekend, my must-read is an amusing and painfully true article from the san francisco chronicle, a list titled i learned it at the movies and it is not true. number 3 by the way is particularly painfully true. it is up on our facebook page.

just when you thought you wouldn't have to endure any more campaign ads for a while there is a whole new round of ads focusing on the fiscal cliff talks. >> some politicians seem to think medicare and social security are just numbers in a budget. well, we worked hard for those benefits. we earned them. in washington tries to cram decisions about the future of the programs into a last minute budget deal we'll all pay the rice. >> the rate on the dividends would more than double. >> we depend on our dividends to help pay our bills. we worked hard to save. >> the president and congress have to work together to stop this dividend tax hike. >> before it is too late. >> here to talk about the campaign to avoid the fiscal cliff former pennsylvania congressman and navy three star admiral joe staff and republican strategist and former huckabee campaign manager chip saltsman.

like like ae wanted like a couple billion dollars of ads wasn't enough during the campaign, we crave more. i don't know, do you think this can be an effective strategy to get people to pressure congress? >> i don't think it can be nor should it be. i think we have to keep our eye on the ball right now. we know what we have to do and it is $4 trillion of debt reduction over the next ten years and then we'll have what americans most need, a sustainable debt to gdp ratio. we have two leaders who have an effort to do a principle compromise and mr. obama who doesn't face another election, and mr. boehner who is head of a party somewhat chastised in the past election about appearing not to let washington work. if we can have the bipartisan compromise not dissimilar to the simpson-bowles national debt commission where we understand it is going to take revenue enhancements as well as spending reductions and entitlement reform, we can do what's right. we must do what's right for america. i think we have a real

opportunity to do it, probably a short team deal by 1 january, but the real negotiation will then be done before we break the real debt ceiling in the middle of march. >> clearly these folks aren't spending money just to spend money. they think they can have influence by influencing people to influence congress. are they right? >> well, they're trying to set the table. no question. i always challenge people to advertise in december. you can't out spend santa claus, and it is hard to get through a message now with the lame ducks folks in congress. i agree with the congressman. i think you will see a band-aid until the spring. >> let me stop you there. there is a new report this morning and the white house is using actually the holiday shopping season to warn about the impact of allowing bush tax cuts to expire for those earning less than $250,000 a year and it says consumers will spend about 200 billion less than 2013, so maybe they're trying to work this whole holiday shopping thing into the theme.

>> look, i think all republicans and democrats hope lots of people spend money during the christmas season and help drive the economy because it is good for everybody. i think at the end of the day the individual ads with different groups trying to get specific issues interjected in the conversation, that will be a real tough sell right now. as you have the folks huddled in washington starting this evening it is the lame duck folks and also more worried about committee assignments than probably the fiscal cliff and they're going to get real serious over the next couple weeks and i am not sure the targeted ads will make a real impact on the decision process. >> there is another thing going on by the obama campaign and they use millions of e-mails to help them in a lot of different ways during the campaign to get people to volunteer and get out the vote and now taking the same e-mails and sending out messages to them. one asks supporters to forward an explanation of the obama plan to friends. the president is planning rallies in key states. can this help the white house

and because of the incredible system that they had set up during the campaign, does this give them an advantage, admiral? >> i think it is something mr. obama learned a lesson about. i think he went to washington and somewhat forgot he had been elected almost i would say by a lot of moderate republicans and he had the people power behind him and i think he was somewhat caught up. as he once said, he couldn't change washington from the inside and i think sometimes reminding people what's at stake is not a bad tactic. all of that said, what i really do believe most is he has to keep in mind 47% of the people did vote for mr. romney and i think what he has to come across at is a very pragmatic individual. that's what americans, i tell you, in pennsylvania that's what we want is a pragmatic approach. step aside from the ideology. when 60% of the budget has to do with entitlements, you know it has to be addressed. then on the other hand, when you have seen the tax rates for the top 1% in the last 50 years has gone down 40%, by the other 99%

overall tax rates have remained essentially saying you understand where at least for the first traurj of tax revenues we have to go, but the end of the day we need everyone to do a shared sacrifice and i hope this president with mr. boehner stays the course. we know the bipartisan principle approach that must be done. it is going to take both spending reductions, entitlement reform, and tax quite frankly revenue increases. >> chip, i was also thinking this weekend as i was looking at the numbers this morning about how well they did on black friday and what they're expecting on cyber monday today that it does seem to give the impression that people are feeling that the economy is getting better. they're willing to spend a little more this holiday season if the early returns are any indication. i wonder if that helps to bolster sort of the president's argument if they feel like he has done a job the things are moving in the right direction and maybe he knows what the answer is here in these negotiations. >> i think that's certainly possible and here is what i think. people are feeling a little bit better mostly because the election is over.

>> and they thought the commercials were going to stop. >> and here we go again. the people i talk to want this to be over. they're very concerned about big issues out there and the fiscal cliff being a big one. they want the economy to do better and i think the american people as a whole are hoping this is the christmas that turns it around and if they can be part of that i think they will be. >> can i add something to that? i think this is an important point. as much as we all want to get the debt under control and we must, i think to keep the economy edging forward like it appears to be is part of the reason why a short team deal is not a bad idea. take the alternative minimum tax. if the inflation index isn't advanced for that and i believe republicans and democrats want to do it, 23 million middle class americans will have a 2,000 to 3,000 dollars tax increase on that alone. >> let me interrupt you for a second. i was making this point a little earlier when you start talking

about these financial things, you know, the i don't want so say minutia but the more specifics of the negotiations and what the numbers mean and the two different sides will tell you that the numbers are different, it is kind of hard for the average person on who doesn't have an mba to figure out what's going on here.

night and despite controversy surrounding ticket prices that ranged from $170 to almost 2,000 a piece, reviews suggest the band delivered. the rolling stones are coming across the pond next month and have concerts scheduled in the new york area. retailers hope the robust holiday spending continues today. cyber monday. a new survey from the national retail federation that finds it is off to a strong start. the average shopper spent $423 this weekend up from 398 last year for a total of $59.1 billion, up 13% almost. mandy drury is here with what's moving your money. more than half of all workers say they will do shopping at work today. >> yes. never doubt the power of the american consumer, right? this cyber monday is apparently going to be the biggest online shopping day of the year for the third year in a row.

according to research firm comscore, i have data here, they say americans will spend $1.5 billion, up from $1.25 billion last year on the cyber monday and obviously retailers are out there and ramping up the deals and doing what they can and putting out great promotions to get you to click on their website. keep in mind and here is your warning, chris, apparently career builder reports a quarter of employers have actually fired someone for using the internet or doing something non-work related on their computers. just keep in mind that your boss may be seeing what you're doing. >> of course you can always say i am just doing research. >> right, research. >> i love this every year. i don't know why. they always put a price tag on the 12 days of christmas and we just got that, too. >> obviously it is all a little fun. there are two things basically pushed up the price this year. you have, number one, a better and improving economy and number two, the drought, which really pushed up feed costs for large

this could be a pivotal week for same sex couples. big decisions looming for the supreme court. pete williams joins us. pete, the justices will meet behind closed doors on friday. what's on the agenda. >> let me tell you what i think the court is going to. do the closest you get to certainty in a supreme court, i believe it will take up challenges to the fert defense of marriage act which is a law signed by president clinton and the part being challenged is the one that says as far as the federal government is concerned, marriage can only consist between a man and a woman. what the law means is that in the states that allow same sex marriage, the federal government doesn't recognize them. if the challengers were successful and that part were struck down, it wouldn't mean

the states have to grant same sex marriage, it would sim mr. i mean in the states where marriage is legal the federal government would have to recognize the marriage tax consequences, federal benefits and so forth. the court will also consider the challenge to the whole question of whether states must grant same sex marriage. that's the big california case, the prop 108 case and less certain the court will take that case, i think. those are the two biggies that we'll watch. we may or may not find out on friday whether they will take them. we'll find out friday or the following monday. >> there is also some late breaking news in just the past hour. immediate challenges after the president's health care law became law. what's this latest announcement about? >> this is one of the first challenges to the law actually filed before the supreme court rule. this was brought by liberty university, a christian college in virginia that claims the employer mandate, the individual mandate violate religious freedom. what the supreme court basically said is we're not going to
